Article 1 | Definitions

In these terms and conditions, the following definitions apply:

  • Cooling-off period: the period within which the consumer can exercise their right of withdrawal;

  • Consumer: the natural person who does not act in the exercise of a profession or business and enters into a distance contract with the entrepreneur;

  • Day: calendar day;

  • Long-term transaction: a distance contract relating to a series of products and/or services, the delivery and/or acceptance of which is spread over time;

  • Durable data carrier: any means that enables the consumer or entrepreneur to store information addressed personally to them in a way that allows future consultation and unchanged reproduction of the stored information;

  • Right of withdrawal: the consumer’s option to withdraw from the distance contract within the cooling-off period;

  • Model withdrawal form: the model form for withdrawal made available by the entrepreneur, which a consumer can complete if they wish to exercise their right of withdrawal;

  • Entrepreneur: the natural or legal person who offers products and/or services remotely to consumers;

  • Distance contract: a contract concluded within the framework of a system organized by the entrepreneur for the remote sale of products and/or services, whereby up to and including the conclusion of the contract, only one or more techniques for remote communication are used;

  • Technique for remote communication: means that can be used for concluding a contract without the consumer and entrepreneur being simultaneously present in the same location;

  • General Terms and Conditions: these present General Terms and Conditions of the entrepreneur.

Article 3 | Applicability

These general terms and conditions apply to every offer made by the entrepreneur and to every distance contract and order concluded between the entrepreneur and the consumer.
Before the distance contract is concluded, the text of these general terms and conditions shall be made available to the consumer. If this is not reasonably possible, it will be indicated before the contract is concluded that the general terms and conditions can be inspected at the entrepreneur’s business premises and will be sent free of charge as soon as possible at the consumer’s request.
If the distance contract is concluded electronically, the terms may be made available electronically before the contract is concluded in such a way that the consumer can easily store them on a durable data carrier. If this is not reasonably possible, it will be indicated where the terms can be inspected electronically and that they will be sent free of charge electronically or otherwise upon request.
If, in addition to these general terms and conditions, specific product or service terms apply, the second and third paragraphs apply accordingly. In case of conflicting terms, the consumer may invoke the provision most favorable to them.
If one or more provisions in these terms are wholly or partially void or annulled, the agreement and these terms remain in force for the remainder. The invalid provisions shall be replaced by provisions that approximate the intent of the original as closely as possible.
Situations not covered by these terms shall be assessed in accordance with the spirit of these terms.
Any ambiguity in the interpretation or content of one or more provisions shall be interpreted in accordance with the spirit of these terms.


Article 4 | The Offer

If an offer has a limited validity period or is subject to conditions, this will be explicitly stated in the offer.
The offer is without obligation. The entrepreneur reserves the right to modify and adapt the offer.
The offer contains a complete and accurate description of the offered products and/or services, sufficiently detailed to allow a proper assessment by the consumer. Images, if used, are a faithful representation of the products/services. Apparent mistakes or errors do not bind the entrepreneur.
All images and specifications are indicative and do not entitle the consumer to compensation or annulment of the agreement.
Product images may not exactly match the real colors.
Each offer contains information that makes clear the rights and obligations connected to acceptance, including:

  • the price inclusive of taxes;

  • any shipping costs;

  • how the contract will be concluded and what actions are necessary;

  • whether the right of withdrawal applies;

  • payment, delivery, and execution methods;

  • acceptance period or price guarantee period;

  • communication costs if other than regular tariffs apply;

  • whether the contract will be archived and how the consumer can consult it;

  • how the consumer can verify and correct data provided before concluding the contract;

  • any other languages available for concluding the contract;

  • codes of conduct the entrepreneur subscribes to and how to consult them electronically;

  • minimum duration for long-term transactions.


Article 5 | The Agreement

The agreement is concluded, subject to paragraph 4, at the moment the consumer accepts the offer and fulfills the conditions.
If the offer is accepted electronically, the entrepreneur will confirm receipt electronically without delay. Until confirmation, the consumer may dissolve the agreement.
The entrepreneur takes appropriate technical and organizational measures to secure data transfer and provide a safe web environment. For electronic payments, appropriate security measures are applied.
The entrepreneur may investigate whether the consumer can meet payment obligations and refuse or conditionally accept orders based on justified reasons.
The entrepreneur will provide the consumer, in writing or on a durable data carrier, with:

  • the business address for complaints;

  • conditions and procedure for exercising the right of withdrawal or an explicit notice of its exclusion;

  • warranty and after-sales service information;

  • information referred to in Article 4(3) unless already provided;

  • cancellation requirements for agreements longer than one year or indefinite duration.
    For long-term transactions, the above applies only to the first delivery.
    Every agreement is conditional on the availability of the products.


Article 6 | Right of Withdrawal

When purchasing products, the consumer has 14 days to withdraw without giving reasons, starting the day after receipt by the consumer or their designated representative.
During this period, the consumer shall handle the product and packaging with care and only unpack/use to the extent necessary to assess if they wish to keep the product.
If exercising the right of withdrawal, the product must be returned with all accessories, in original condition and packaging, following reasonable and clear instructions from the entrepreneur.
The consumer must notify the entrepreneur within 14 days after receipt of their decision to withdraw, using the model form or other communication means such as email. The product must then be returned within 14 days. Proof of timely return (e.g., shipping receipt) must be provided.
If the consumer does not notify or return the product in time, the sale is final.


Article 7 | Costs in Case of Withdrawal

The consumer bears at most the costs of returning the product.
If payment has been made, the entrepreneur will refund it within 14 days after withdrawal, provided the product has been received or proof of return is provided. Refunds will be made via the original payment method unless otherwise agreed.
The consumer is liable for diminished product value caused by careless handling.
Liability does not apply if the entrepreneur failed to provide legally required information on withdrawal before concluding the contract.


Article 8 | The Price

Prices stated in the offer are fixed during the stated validity period, except for VAT changes.
Prices subject to financial market fluctuations may be variable; this is clearly stated in the offer.
Price increases within 3 months of agreement are only allowed if legally required.
After 3 months, increases are allowed if agreed upon and either due to law or the consumer may terminate the contract on the increase date.
Prices include VAT.
Typographical errors do not obligate the entrepreneur to honor the incorrect price.


Article 9 | Conformity and Warranty

The entrepreneur guarantees that products/services comply with the agreement, offer specifications, reasonable durability/usefulness expectations, and legal regulations existing at contract conclusion.
If agreed, products are also suitable for non-normal use.
Guarantees provided do not affect statutory rights or claims against the entrepreneur.
Defects or wrong deliveries must be reported in writing within 2 months after delivery. Returns must be in original packaging and new condition.
Warranty does not cover damage due to abnormal use, careless handling, or violation of instructions.


Article 10 | Delivery and Execution

The entrepreneur will exercise utmost care in receiving and executing orders.
Delivery takes place at the consumer’s provided address.
Accepted orders will be executed promptly, within 30 days unless otherwise agreed.
If delivery is delayed or incomplete, the consumer will be informed within 30 days and may dissolve the contract without cost; no compensation applies.
Delivery times are indicative. Overruns do not entitle compensation.
In case of dissolution, payments will be refunded within 14 days.
Risk of damage or loss rests with the entrepreneur until delivery to the consumer or their designated representative, unless otherwise agreed.


Article 11 | Payment

Unless otherwise agreed, payments are due within 7 days after the cooling-off period starts.
Consumers must report any incorrect payment details immediately.
In case of non-payment, the entrepreneur may charge reasonable costs as communicated beforehand.


Article 12

| Complaints Procedure

The entrepreneur has a complaints procedure, visible and accessible on the website or upon request.
Complaints about delivered products/services must be reported within 14 days after discovery but at most 2 months after delivery.
The entrepreneur will confirm receipt of complaints within 5 working days and respond substantively within 4 weeks.

Article 13 | Disputes

These terms are governed by Dutch law.
Disputes shall be submitted to the competent court in the district where the entrepreneur is established, unless mandatory law dictates otherwise.


Article 14 | Additional or Deviating Provisions

Additional or deviating provisions agreed in writing between entrepreneur and consumer override these general terms and conditions.
